Couple in court for allegedly stabbing neighbours

Chidi Ucheonye, 38, and his wife, Chioma, 36, on Wednesday appeared in Chief Magistrates’ Court in Ado-Ekiti for allegedly stabbing their neighbours with a knife.
The police charged the couple with of breach of peace and assault.
The Prosecutor, Insp Johnson Okunade, told the court that the defendants committed the offence on June 13 at about 8.30 p.m in Ado-Ekiti.
Okunade alleged the defendants stabbed their neighbour Rabiu Aliu and his wife, Bukola.
The prosecution also alleged that the defendants conducted themselves in a manner likely to cause breach of peace by pouring a liquid, suspected to be a”spiritual concoction” into the house of Aliu and his wife.
The offence, he said, contravenes  the provisions of sections 249(d) and 355 of the Criminal Code, Laws of Ekiti State, 2012.
The prosecutor asked the court for an adjournment to enable him study the case file and present his witnesses.
The defendants pleaded not guilty to the charges preferred against them.
Their counsel, Mr Abiola Gboyega, prayed the court to grant the defendants bail in the most liberal terms.
The Chief Magistrate, Mr Adedayo Oyebanji, granted bail to the defendants in the sum of N50,000 and one surety each in like sum.
He adjourned the case until July 15 for hearing.

Alleged homicide: Court discharges, acquits El-Zakzaky, wife

A Kaduna High Court, on Wednesday discharged and acquitted leader of the proscribed Islamic Movement in Nigeria (IMN), Ibrahim El-Zakzaky and Wife Zeenat.

Justice Gideon Kurada, in an eight-hour ruling in the no-case submission application, filed by the defendants.

Counsel to the defendants, Marshal Abubakar who represented the lead counsel in the suit, Femi Falana, SAN, told reporters shortly after the trial ended in Kaduna.

“The trial of Sheik El-Zakzaky and his wife Zeenat has come to end as the court found them not guilty of the alleged crime, filed against them by the Kaduna State Government.

” The court found that the charges that were filed in 2018 pursuant to the Penal law enacted by the State Government in 2017 over an alleged offence committed in 2015.

” The court presided by Justice Gideon Kurada, ruled that the charge was not suppose to be filed in the first place, as the government cannot arraign someone for a said crime that was not an offence at the time.

” The court ruled that the charge was incompetent as the court agreed that El-Zakzaky and his wife had committed no offence.

” The court also holds that the event of Dec.12 2015 and Dec. 15, 2015 was not an offence and the court was emphatic that none of the events in Dec. 12, 2015 can be attributed to the defendants for an offence.

” The court, thereby, discharges  and acquits the defendants, as there should have been no charge in the first place.

” No party asked for cost of fine, “Abubakar told reporters.

Mr Dari Bayero, the lead prosecution team, however, declined comment on the ruling as he drove out of the court premises.

The Kaduna State Government had charged El-Zakzaky and Zeenat with eight counts, bordering on alleged culpable homicide, unlawful assembly and disruption of public peace, among other charges.

The defendants had pleaded not guilty to the charge.

The News Agency of Nigeria (NAN) reports that on Sept. 29, 2021 the court dismissed a no-case submission filed El-Zakzaky and his wife Zeenat.

In the motion, El-Zakzaky asked the court to dismiss the allegations against him and his wife for lack of evidence.

But in his ruling, Justice Kurada, dismissed the no-case submission, saying that it was premature to rule on the application to quash the charges against the defendants in view of the clear provisions of the Kaduna State Administration of Criminal Justice.

20 bag first class as Law School graduates 4, 350

(NAN)Twenty persons passed with first class out of a tota of 4, 350 successful candidates who participated in  the March 2021 Bar Final Examination of the Nigeria Law School.

The Director General of the Nigerian Law School, Prof. Isa Ciroma disclosed this while presentating the successful candidates for July 2021 Call to the Nigerian Bar, to the Body of Benchers on Wednesday in Abuja.

Ciroma said that a total of 5, 770 candidates sat for the March 2021 Bar Final Examination.

” Total number of candidates who participated in the examination were 5, 770 and out of the number, 4, 350 candidates were successful with 20 recording first class”, he said.

He said that the figures represented 75 per cent success of the final examination.

Ciroma assured that  the institution shall continue to remain the gate keepers of law profession, adding “as teachers, and administrators, we will continue to uphold the standard and integrity of the Bar.”

Summary of the result showed that 432 candidates made Second Class Upper, 2, 174 made Second Class Lower while 1, 724 others had pass.

NAN recalled that the school had on Tuesday, graduated and Called to the Nigerian Bar, 884 candidates from its December 2020 batch in addition to four others from previous batch.

In his address, Justice Olabode Rhodes-Vivour, Chairman, Body of Benchers said that the graduates were expected to adhere to the provision of Rules guiding the profession, at all times.

“I urge you to conduct yourselves in the most responsible way expected of you as people in a noble profession.

” As a lawyer, you are an officer of the court and accordingly, you are not to do any act or conduct in a manner that will obstruct or adversely affect the course of justice.

” The practice of Law is not a right but a privilege.

” It is a privilege that can be lost should you fail to live up the requisite professional standards imposed upon you by virtue of your entry into the community of lawyers”, he said.

He warned that the Body of Benchers Legal Practitioners Disciplinary Committee was always determined to discipline any lawyer found wanting or breaching set rules of the profession.

RhodesVivour hinted that his committee had from January to July, disbarred six lawyers, suspended some following none adherence to the laid down rules

“Be of good behavior in the course of your operations and abide by the ethics and values of the profession, to avoid being brought before the committee”, he advised.

Rhodes-Vivour also encouraged the graduates to continue to read and update their knowledge on both statute and case law in order to grow in the profession.

Akeredolu, Boroffice laud Supreme Court’s verdict on Ondo Governorship election

Gov. Oluwarotimi Akeredolu of Ondo State and Dr Ajayi Boroffice, the Deputy Leader of the Senate, have lauded the Supreme Court’s judgment on Oct. 10 governorship election in the state.
The apex court had on Wednesday declared Akeredolu winner of the election in an appeal filed before it by Eyitayo Jegede, Governorship candidate of the Peoples Democratic Party (PDP).
Jegede had approached the courts on grounds that the nomination of Akeredolu by the All Progressives Congress (APC) was unconstitutional.
Akeredolu had earlier won at the Tribunal and Appeal Court, which the Supreme Court now upheld.
The governor, at a news conference in Akure, thanked the people of Ondo Stateand his legal team for their patience and resilience during the trials.
Akeredolu said his legal team worked tremendously to ensure that justice prevailed, and all efforts to return him to office was not in futility.
“The judgment in total, from the results of tribunal to Supreme Court, shows that I had a gallant victory at the Oct. 10, 2020 governorship election,” he said.
The governor said the time had come to continue infrastructure development in the three senatorial districts.
Akeredolu called on Jegede to “work hand in glove” with him to continue the development of the state.
Also, Boroffice, in a statement by his Media Aide, Mr Kayode Fakuyi,  said the judgment was consistent with the wishes of the good people of the state.
He, therefore, extended warm felicitation to the governor and all members of APC in the state.
